General Terms and Conditions

1. Scope of application

1.1 These General Terms and Conditions (T&Cs) apply to all contracts for the purchase of goods that you conclude with us, gepepharm GmbH, Josef-Dietzgen-Straße 3, 53773 Hennef, Germany, via our online shop.

1.2 Deviating conditions of the customer are not accepted unless the seller expressly agrees to their validity.

1.3 A consumer in the sense of these terms and conditions is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to their commercial nor their self-employed professional activity (Sect. 13 German Civil Code, BGB).

1.4 A sale to customers who are exercising a commercial or self-employed professional activity and therefore act as entrepreneurs, or a sale of quantities exceeding customary household quantities must be reported to us separately in advance.

2. Contract Conclusion

2.1 The product descriptions contained in the seller’s online shop do not represent binding offers on the part of the seller but serve to provide a binding offer by the customer.

2.2 You may initially add products to the virtual shopping cart without obligation. After clicking the “Continue to checkout” button you can enter your delivery and invoice data and select a payment method. You can use the correction aids provided for this purpose during the ordering process if you want to edit your entries at any time before submitting your binding order. By clicking the “Buy now” button you are placing a binding order for the products in your shopping cart. Confirmation of receipt of your order is sent by e-mail immediately after you submit your order.

2.3 The point of time when the contract with us will be concluded depends on the method of payment you have chosen:

Amazon Pay

During the ordering process you are redirected to the website of the Amazon online provider before completing your order process in our online shop. There you can select the delivery address and payment method stored with Amazon and confirm your payment instruction to Amazon. You can then complete the ordering process as usual in our online shop. After submitting your order, we will ask Amazon to initiate the payment transaction, thereby accepting your offer.

PayPal

After completing the ordering process you are redirected to the website of the PayPal online provider. There you can initiate a payment instruction to PayPal. By requesting a payment transaction to PayPal we accept your offer.

2.4 We do not store the contractual text.

2.5 Order processing and contacting you are usually done by e-mail and in an automated manner. The customer must ensure that the e-mail address provided for order processing is correct so that e-mails sent by the seller can be received at this address. In particular, when using spam filters, the customer must ensure that all e-mails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.

3. Right of Cancellation

3.1 Consumers are generally entitled to a right of cancellation.

3.2 Please see the seller’s cancellation policy for more detailed information on the right of cancellation.

4. Pricing and Shipping Costs

4.1 All prices quoted on the seller’s website are inclusive of applicable statutory value added tax.

4.2 In addition to the prices stated, the seller will charge shipping costs for delivery. Shipping costs will be clearly communicated to the buyer on a separate information page and during the ordering process.

5. Payment Methods

5.1 The following payment methods are available for deliveries:

  • Amazon Pay
  • PayPal

5.2 Unless otherwise stated for the individual payment methods, payment claims arising from the concluded contract are due for payment immediately.

6. Delivery and Shipping Terms

6.1 Goods are delivered by dispatch to the delivery address specified by the customer. The delivery address specified during the seller’s order processing is decisive for processing the transaction. The above notwithstanding, if PayPal was chosen as the payment method, the delivery address stored by the customer with PayPal at the time of payment is decisive.

6.2 If the carrier returns the dispatched goods to the seller because delivery to the customer was not possible, the customer bears the costs of the unsuccessful dispatch. This does not apply if the customer (i) effectively exercises their right of cancellation; (ii) is not responsible for the circumstance that led to the impossibility of delivery; or (iii) was temporarily prevented from accepting the service offered, unless the seller had given them reasonable advance notice.

6.3 Self-collection is not possible for logistical reasons.

7. Retention of Title

The product delivered to you remains our property until full payment has been received.

8. Liability for Faults( Warranty)

8.1 In case of faults of the delivered purchase item, you are entitled to the statutory rights within the scope of warranty/liability for faults, guarantee claims notwithstanding.

8.2 The customer is requested to file a complaint with the carrier about delivered goods with obvious transport damages and to inform the seller about this.

9. Vouchers

9.1 Voucher codes issued by gepepharm GmbH are not available for purchase. They are issued exclusively within the scope of advertising campaigns. Vouchers are only valid in their specified periods. Vouchers expires after a single use or after their periods of validity have expired.

9.2 Individual products may be excluded from a voucher campaign. For further information, please see the respective voucher terms and conditions.

9.3 Promotional vouchers can only be redeemed before completing the ordering process. Subsequent redemption is not possible.

9.4 Only one promotional voucher can be redeemed per order.

9.5 The value of the goods must be equal to or exceed the promotional voucher’s value. Any remaining credit will not be refunded by the seller.

9.6 If the promotional voucher’s value is smaller than the order total, one of the other payment methods offered by the seller can be used for settling the difference.

9.7 The credit balance of a promotional voucher is neither paid out in cash nor does it bear interest.

9.8 The promotional voucher is not refunded if the customer returns the goods paid for in full or in part with the promotional voucher within the scope of their statutory right of cancellation.

9.9 The promotional voucher is transferable. The seller may perform with exempting effect towards the holder redeeming the promotional voucher in the seller’s online shop. This does not apply if the seller is aware of or recklessly ignorant of the holder’s non-authorisation, legal incapacity or lack of right of representation.

10. Data Privacy

We collect, process and use your personal data to the extent necessary for establishing, implementing or terminating this contract. Any further collection, processing and use of your personal data only takes place if a legal provision permits this or if you have given your consent to do so. 11. Applicable Law

This agreement is subject to Federal German law. The United Nations Convention on Contract for the International Sale of Goods are hereby excluded. Contracts with consumers are only governed by this applicable law if no protection is provided by mandatory statutory provisions in the consumer’s country of habitual residence.

12. Place of Jurisdiction

If the customer acts as a merchant, a legal entity under public law or a special fund under public law with their registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the seller’s registered office. If the customer’s registered office is outside of the territory of the Federal Republic of Germany, the seller’s registered office is the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer’s professional or commercial activity. In the above cases, however, the seller is in any case entitled to seize the court at the customer’s place of business.

13. Alternative Dispute Resolution

13.1 The EU Commission provides an internet platform for online dispute resolution at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for out-of-court settlements of disputes arising from online purchase or service contracts involving a consumer.

13.2 The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

14. Severability Clause

If individual provisions invalid or unenforceable in full or in part, or if they lose their legal validity or enforceability at a later date, the validity of the remaining provisions remains unaffected. The invalid or unenforceable provisions are replaced by the statutory provision.
